Can Trump Pardon Derek Chauvin? Only For His Federal Convictions.

Can Trump pardon Derek Chauvin? Only for his federal convictions.

Chauvin was convicted on both state and federal charges in 2021. He pled guilty in December 2021 to two federal charges for deprivation of civil rights under the color of law for the murder of George Floyd and for a 2017 assault on a 14-year-old.

The federal criminal convictions are the only ones a president can pardon, under Art. 2, Sec. 2, Clause 1 of the Constitution.

Even if pardoned federally, he must still serve his state sentence: 22.5 years for second-degree murder in Minnesota. As AG Keith Ellison said, “He still owes Minnesota… he’s not getting out.”

Know the facts. Share the truth.
